bay point continues tonight. it happened monday. the woman said a man attacked her and fondled her. police say the attacker is a african american man, 40 years old, wearing all black and riding a blue bike. the city of oakland is suing the government to prevent the seizure of a building. the property in question is a medical marijuana dispensary called the harbor side health center. it operates under a city issued permit. it asks the court to declare the government's attempt to close it down as unlawful. the supreme court heard arguments in a case that could have effects on college

admissions. demonstrators gathered. the appeal involve as lawsuit filed by a student who claims she was denied admission to the university of texas because of her race. they say the court has become conservative. a slight drop in the number of job opens is a sign of a slow recovery. there were 30,000 fewer job opening in august compared to july. and the rate at which workers quit stayed the same for six months in a row. before the recession it was above 2%. on wall street today stocks fell as the earnings season gets underway. the dow is down 128 to 13,344. the nasdaq is down 13 at 3,051. standard and poor's hit

began. ktvu's paul chambers tells us why it is making some folks nervous. >> reporter: there are a dozen protesters at city hall right now. they are preparing for the party. this is the one year anniversary. there is 50 people here to mark that anniversary. members are calling it a birthday party but businesses say there is nothing to celebrate. >> reporter: some businesses are still dealing dealing dealing with the mess after last weekend's protest by occupy. with word the movement is back, local businesses are not happy. >> you will have to worry about your car. stand in front of your business, if you are a small business owner, you will have to have an extra employee to watch your business at night. >> reporter: it says open for business but you could hardly tell. many businesses decided to add boards up just in case.

>> it is ridiculous. most people understand why they are angry, but you are messing up your own neighborhoods. >> reporter: one year ago today the occupy movement began in oakland when people held protests and set up camp outside city hall. once they were told to leave it set up several confrontation between occupy and police. today people say they don't have an issue with the message, just the manner in which some are delivering it. >> at night time the police fighting against, you know, the occupiers. >> i will support anybody that wants to speak their mind but do it correctly. don't effect the small people you are trying to help. >> reporter: i spoke with the mayor's office and police, police talked to some people, they say there are no problems

but there are additional officers just in case. right now everything is peaceful. but they have a plan just in case something happens. paul chambers ktvu channel 2 news. gas prices dipped today after surging. prices range from $4.73 to $466 in the bay area. they expect prices to fall now that governor jerry brown ordered the early production of winter blend gas. chevron says the fire damaged unit will not reopen soon and that could help keep prices up. he is trying to keep prices down by reign in california's oil refineries. he says they have no incentive to keep safe because accidents increase profits. costs following accidents are

passed on to the consumer through higher gas prices. the california energy commission awarded $20 million in grants for transportation projects, including $10 million to fremont tesla motors. they are aimed at producing a new all electric suv. they plan to match the grant with $50 million. the state expects the project to generate more than 500 new manufacturing jobs. investigators in los angeles are trying to figure out how a man carrying weapons made it past airport security. pictures here of those weapons. clubs, knives, and a hatchet. police say he was caught wearing a bullet proof vest last friday. he traveled from japan to korea and then into the united

an issue? typically it could be worse if we didn't have rain. i haven't heard of fires but that is what you think about. the rain is really coming down. you can see it up there in the bolder creek. let me put the motion in here. unusual direction. there is the warning. works its way to the west. that is an unusual direction as the low pressure center drifts down the coast. the severe thunderstorm has gone away. but look at this. this is how the system is set up. significant. los gatos noticed it. it was coming down hard. quarter size hail. sometimes that trigthers severe thunderstorm warning. -- trillers the severe thunderstorm warning. that rain is going off shore. right?

the u.s. anti-doping agency made public its reasoning used to suspend lance armstrong. they say 11 of his former teammates gave evidence against him. lance armstrong accused them of
